1 - Object and Acceptance of the General Terms and Conditions
Qiriness welcomes you to its website, accessible at the following URL: www.qiriness.com

The Site Qiriness France (hereinafter referred to as the "Site") published by Qiriness (Simplified Stock Company with a capital of € 139,990, 5 quai Dion Bouton in Puteaux, RCS 448995274, Director of Publication Ms. Beilvert, Tel. 0811.701.748 call without surcharge for order follow-up), hereinafter referred to as the "Seller", offers cosmetic products for sale to consumers in metropolitan France. For the purposes hereof, it is agreed that the consumer who has validated an order will then be referred to as "Purchaser".

The contract language used by Qiriness is the French language.

It is possible to save or print these General Conditions of Sale, provided you do not modify them.

The present General Terms and Conditions are valid from October 1st, 2017.

The Seller reserves the right to modify the present General Terms and Conditions and specific sales conditions at any time, without notice, with the understanding that such modifications are not applicable to orders previously accepted and confirmed by Purchaser.

2 - Products Sold on Site

Purchaser may, prior to his order, learn more about the main characteristics of the products on the Qiriness France Site.

The sales offers are valid as long as they are proposed on the Site.

3 – Prices
The prices shown on this Site are indicated in Euro all taxes included, excluding postage, for deliveries in metropolitan France. They are subject to variations during the year, it being understood that the products ordered are invoiced at the prices in force at the time of the order.

The section My Cart and the order summary outlines the costs of packaging and shipping to the Customer in addition to the price of the products.

Prices include tax (VAT) applicable on the day of the order and any change in the applicable rate will be automatically adjusted in the price of products sold by Seller on the Site.

4 - Orders
In the case of natural persons, the Customer declares that they are at least 18 years of age and has the legal capacity or parental authorisation to place an order on the Site. The Customer guarantees the veracity and accuracy of the information that they communicate during their purchase.

To purchase Qiriness Products, you must click on the product on the Site catalogue, open a customer account under "My Account” and fill in the form accessible in the section "My cart" (the mandatory sections are indicated by an asterisk). We invite you to read carefully the summary that appears on the screen, before confirming your order and proceeding to payment online. The sale of the Qiriness Products is definitively concluded when you click on the button "Place the order"; up to this point, you can cancel the current order or rectify errors.

The order can be printed. The Seller recommends that the Purchaser retain the information contained in the order confirmation sent by the Seller on a paper or computerised document.

Upon registration of the order, a detailed acknowledgement of the order will be sent to the Purchaser, at the email address that they will have indicated.

This acknowledgement of receipt recalls the exact amount invoiced and the terms of delivery of the order. We invite you to keep it to facilitate the tracking of your order.

This acknowledgement of receipt constitutes acceptance of the order and will validate the transaction subject to payment of the order. Upon validation of the payment, the order is registered and becomes irrevocable.

However, Seller reserves the right to suspend or cancel any order from a Purchaser with whom there is a legal dispute concerning the payment of a previous order or for any other legitimate reason, in particular any abnormality noted in the order.

5 - Payments
All orders are payable in euros.

To pay for the order, the Purchaser disposes of the following payment methods: Visa or Master Card credit cards, or PayPal account.

Purchaser guarantees to Seller that he is in possession of the authorizations necessary to use the method of payment selected during the placement of the order.

The Seller reserves the right to suspend or cancel any order or delivery, regardless of its type and stage of processing, in the event of non-payment or refusal of payment authorisation of any amount that is due by Purchaser or in the event of any problem relating to payment.

In the event of an official investigation against fraud on the Internet, information concerning your order may be forwarded to competent authorities for verification.

When choosing payment by PayPal account and to ensure the security of the payment by credit card, the Purchaser will have to transmit to PayPal the visual cryptogram (CVV) of their credit card.

PayPal handles payments, refunds and refusal due to debit.

Payment security on the Site is assured by PayPal.

In the same way, when choosing payment by Visa or Master Card credit card and in order to ensure the security of the payment by credit card, the Purchaser will have to transmit to BNP PARIBAS the visual cryptogram (CVV) of their credit card.

6 – Delivery
Orders are processed and sent during work days (from Monday to Friday, excluding public holidays). Delivery takes an average of 10 days from receipt of the purchase order, and a maximum of 30 days from receipt of the order form.

In Metropolitan France, Monaco and Corsica, delivery is made by Colissimo Expert to the delivery address specified by the Purchaser at the time of the order. With Colissimo Expert delivery, orders are usually delivered within eight working days of shipment.

Abroad, delivery is made by DHL and only in the following countries: United Kingdom, Belgium, Netherlands, Luxembourg, Italy, Spain, Portugal, Germany, Switzerland, Austria, United States and Canada. With DHL delivery, orders are usually delivered within eight working days of shipment.

Delivery times depend on delivery areas and can take an additional 2 days, excluding customs controls.

Delivery charges apply per package. One order can only have one delivery address. To send the same package to multiple addresses, one order for each address must be placed.

Any erroneous or missing mention in the delivery address and in the identity of the Purchaser discharges the Seller from responsibility for delivery.

We recommend that you check the number, references and condition of the Qiriness Products at reception and in the presence of the carrier or postman or postwoman, and then express your reservations on the delivery or reception slip. If it is not possible to check the Qiriness Products in the presence of the carrier or the postman or post woman, we recommend that you indicate "subject to reservations" on the delivery or reception slips that may be presented for your signature at delivery of your order and then, upon delivery, unpack and carefully check the condition and conformity of the Qiriness Products. We advise you to inform us as soon as you receive the packages and in writing of any defect or non-conformity. If it appears likely that a defect has been caused by the postal services, we advise you to file a complaint with your Post Office and send us a copy.

The contact details of all requests concerning after-sales and claims can be found in Section 9.2.

7 – Warranty - Information du consommateur sur les garanties dont il dispose - Arrêté du 18.12.2014
Purchaser can benefit from legal guarantees on hidden product defects and product conformity, according to statutory law.

Le vendeur est tenu :

1.  des défauts de conformité du bien au contrat dans les conditions de l’article L. 217-4 et suivants du code de la consommation et

2.  des défauts cachés de la chose vendue dans les conditions prévues aux articles 1641 et suivants du code civil

Lorsqu’il agit en garantie légale de conformité, le consommateur : 

  1. bénéficie d’un délai de deux ans à compter de la délivrance du bien pour agir ;
  2. peut choisir entre la réparation ou le remplacement du bien, sous réserve des conditions de coût prévues par l’article L. 217-9 du code de la consommation ;
  3. est dispensé de rapporter la preuve de l’existence du défaut de conformité du bien durant les six mois suivant la délivrance du bien. Ce délai est porté à vingt-quatre mois à compter du 18 mars 2016, sauf pour les biens d’occasion.  

 La garantie légale de conformité s’applique indépendamment de la garantie commerciale éventuellement consentie.

Si le consommateur décide de mettre en œuvre la garantie légale contre les défauts cachés de la chose vendue, il peut choisir entre la résolution de la vente ou une réduction du prix de vente conformément à l’article 1644 du code civil.


Article L. 217-9 du code de la consommation : « le vendeur peut ne pas procéder selon le choix de l'acheteur si ce choix entraîne un coût manifestement disproportionné au regard de l'autre modalité, compte tenu de la valeur du bien ou de l'importance du défaut. Il est alors tenu de procéder, sauf impossibilité, selon la modalité non choisie par l'acheteur »

Article L. 217-10 du code de la consommation : « Si la réparation et le remplacement du bien sont impossibles, l'acheteur peut rendre le bien et se faire restituer le prix ou garder le bien et se faire rendre une partie du prix.

La même faculté lui est ouverte :

1° Si la solution demandée, proposée ou convenue en application de l'article L. 217-9 ne peut être mise en œuvre dans le délai d'un mois suivant la réclamation de l'acheteur ;

2° Ou si cette solution ne peut l'être sans inconvénient majeur pour celui-ci compte tenu de la nature du bien et de l'usage qu'il recherche.

La résolution de la vente ne peut toutefois être prononcée si le défaut de conformité est mineur ».

In the event the product ordered is damaged or faulty upon receipt, or if the product received is not the product originally ordered :
- Seller will dispatch replacement items free of charge provided Purchaser first returns the products to Seller in the condition in which Purchaser received them.
- Purchaser may choose to return the product to Seller and obtain a full refund of the returned product, within a maximum period of 30 days following the request by Purchaser.

Les frais de retour du produit non-conforme seront remboursés par le Vendeur.

8 - Return Policy - Informations concernant l'exercice du droit de rétractation - Annexe à l'article R221-3 du Code de la consommation
Purchaser has a period of 14 days from the date of receipt of order, to return at Purchaser’s own expense, the products ordered, for refund.

Reimbursement will be made by bank transfer to the account associated with the card used for payment, after the exercise of Purchaser’s right to return, within 14 days from the date of receipt by Purchaser of the returned products.

Vous avez le droit de vous rétracter du présent contrat sans donner de motif dans un délai de quatorze jours.

Le délai de rétractation expire quatorze jours après le jour où vous-même, ou un tiers autre que le transporteur et désigné par vous, prend physiquement possession du bien.

Pour que le délai de rétractation soit respecté, il suffit que vous transmettiez votre communication relative à l'exercice du droit de rétractation avant l'expiration du délai de rétractation.

Effets de rétractation
En cas de rétractation de votre part du présent contrat, nous vous rembourserons tous les paiements reçus de vous, y compris les frais de livraison (à l'exception des frais supplémentaires découlant du fait que vous avez choisi, le cas échéant, un mode de livraison autre que le mode moins coûteux de livraison standard proposé par nous) sans retard excessif et, en tout état de cause, au plus tard quatorze jours à compter du jour où nous sommes informés de votre décision de rétractation du présent contrat. Nous procéderons au remboursement en utilisant le même moyen de paiement que celui que vous aurez utilisé pour la transaction initiale, sauf si vous convenez expressément d'un moyen différent ; en tout état de cause, ce remboursement n'occasionnera pas de frais pour vous. Nous pouvons différer le remboursement jusqu'à ce que nous ayons reçu le bien ou jusqu'à ce que vous ayez fourni une preuve d'expédition du bien, la date retenue étant celle du premier de ces faits. Vous devrez renvoyer ou rendre le bien, à nous-mêmes ou à E-Shop / Qiriness -  EURODISLOG (Quai OUEST -  Bâtiment SOA 2 -  Z.A.C des Bethunes -  Avenue du Fond de Vaux -  95310 Saint Ouen l’Aumône France) sans retard excessif et, en tout état de cause, au plus tard quatorze jours après que vous nous aurez communiqué votre décision de rétractation du présent contrat. Ce délai est réputé respecté si vous renvoyez le bien avant l'expiration du délai de quatorze jours. Vous devrez prendre en charge les frais directs de renvoi du bien. Votre responsabilité n'est engagée qu'à l'égard de la dépréciation du bien résultant de manipulations autres que celles nécessaires pour établir la nature, les caractéristiques et le bon fonctionnement de ce bien.

3° De fourniture de biens confectionnés selon les spécifications du consommateur ou nettement personnalisés ;

5° De fourniture de biens qui ont été descellés par le consommateur après la livraison et qui ne peuvent être renvoyés pour des raisons d'hygiène ou de protection de la santé ;
6° De fourniture de biens qui, après avoir été livrés et de par leur nature, sont mélangés de manière indissociable avec d'autres articles ».

9 - Instructions for Returns
Whatever the reason for returning products to Seller, Purchaser is advised to follow these instructions to facilitate the return process:

1. Use the original packaging to return the product and in a perfect condition for resale. For hygiene purposes, cosmetic products must be returned in their complete, original packaging, undamaged and in perfect condition for resale. Any product that has been opened or damaged, or any original packaging that has been damaged will not be reimbursed, accepted for return or exchanged.

2 Fill out and enclose a copy of the order delivery receipt, accompanied by a letter containing the following information – name, address, telephone number, order number and e-mail address.

Any and all risks linked to the return of the product remain the Purchaser’s responsibility.

The return shipping expenses are to be paid by Purchaser. In the event of a damaged or faulty product, or if the product received is not the product originally ordered, the return shipping expenses will be refunded.

Purchaser must return any free Gift with Purchase item with the product return to receive the order refund.

10 - Liability
The Seller shall not be held responsible for non-fulfillment of the contract in case of stock rupture or in the event of unavailability of the product due to force majeure.

11- Protection of your personal data (CNIL) [Commission nationale de l'informatique et des libertés] (National Commission for Information Technology and Civil Liberties)

The personal information collected on the site is essential for Qiriness to ensure the presentation of its commercial products and offers, to process orders and their follow-up and to provide consumers with promotional advantages. Additional information, the optional nature of which is specified on the forms, may be collected to get to know you better. In the context of the use of the site, the consumer must provide personal information, the purpose of which is to enable Qiriness to identify them in order to offer them products and services.

It is recalled that the consumer, as well as any person concerned by the data, can obtain the communication and, if necessary, the rectification or deletion of the information concerning them, by addressing the head office of Qiriness. The Qiriness response period is set at two months, in accordance with Article 94 of the Decree of 20 October 2005. Any person may also, for legitimate reasons, oppose the processing of data concerning them.

Qiriness may be led to send e-mails to users to inform them about its products and services. It is possible to refuse to receive these e-mails by sending an e-mail or a letter by post to the addresses indicated above.

In order to adapt the Site to the requests of its visitors, measurements are made of the number of visits, page views as well as the activity of the visitors on the Site and their frequency of return. “Cookie” technology can be used. The User may refuse these "cookies" or delete them without this implying a difficulty of access to the pages of the Site. To prevent the registration of "cookies" or to be notified before accepting it, it is recommended to read the help section of your browser which specifies the procedure to follow. It is also possible to analyse frequenting of the Site from the usage of the connection data, without it being possible to link these data with any personal data of any kind.

12 - Disputes and Applicable Law
The present General Terms and Conditions as well as the sale of Qiriness products are subject to French law.

All claims relating to the interpretation, performance or breach of contract concluded between Seller and Purchaser are the exclusive jurisdiction of the French courts.
